Major Changes to Canada’s Family Work Permit Program: What You Need to Know

The Canadian government has introduced significant restrictions on family work permits for international students and foreign workers to address housing affordability and control temporary resident numbers. Effective January 21, 2025, these changes will impact thousands of families seeking to work and study in Canada. Here’s everything you need to know about these new rules and how they might affect you.

What Are the New Restrictions?

For International Students
Family Open Work Permits (OWPs) will now be restricted to spouses or common-law partners of students enrolled in:
  • Master’s programs last 16 months or longer.
  • Doctoral programs.
  • Select professional and eligible programs, including:
    • Doctor of Dental Surgery (DDS DMD)
    • Bachelor of Law or Juris Doctor (LLB, JD, BCL)
    • Doctor of Medicine (MD)
    • Doctor of Veterinary Medicine (DVM), among others.

Previously, spouses of master’s students were eligible for OWPs regardless of the program duration. Now, the 16-month minimum duration has become a critical requirement.

For Foreign Workers

Family OWPs for foreign workers will be limited to spouses or common-law partners of individuals working in:

  • TEER 0 and TEER 1 occupations.
  • Select TEER 2 or TEER 3 occupations in sectors such as:
    • Healthcare
    • Construction
    • Education
    • Sports
    • Military

Spouses of foreign workers must also ensure that the principal applicant’s work permit has at least 16 months of validity at the time of their application. Notably, dependent children of foreign workers are no longer eligible for family OWPs.

Who Remains Eligible?

Certain groups are exempt from these restrictions, including:

  1. Spouses are covered by free trade agreements (FTAs).
  2. Spouses or partners sponsored for permanent residence (PR) who already hold legal temporary status in Canada.

Renewal of Existing Permits

Existing OWPs issued under previous policies remain valid. Families in Canada can renew their permits if the renewal matches the duration of the sponsoring student’s or worker’s permit.

Why These Changes Were Made

The Canadian government’s decision is part of broader reforms to reduce temporary resident numbers to tackle housing supply and affordability issues. Minister of Immigration Marc Miller announced that these measures are expected to minimise family OWPs issued to international students by 50,000 and foreign workers by 100,000 over the next three years.

This policy shift aligns with the new Immigration Levels Plan targets for the Temporary Foreign Worker Program (TFWP) and the International Mobility Program (IMP):

Temporary Foreign Worker Program82,00082,00082,000

Post-Graduation Work Permit (PGWP) Changes

Additional restrictions also apply to PGWP eligibility for students who applied for a study permit after November 1, 2024. Students must now meet stricter language proficiency and field of study requirements to qualify for a PGWP.

Why Open Work Permits Are Popular

Open Work Permits are highly sought after because they provide flexibility, allowing holders to work for most employers in Canada without being tied to a specific job or employer. Unlike closed work permits, OWPs simplify employment opportunities for newcomers, enabling greater mobility and integration.
