Refugee protection program is for people who have fled their countries because of a well-founded fear of persecution upon returning to their country of citizenship or country of legal permanent residence. The fear of persecution must be one of: religion, race, nationality, membership of a particular social group and political opinion. People seeking refugee protection must be able to prove and/or demonstrate that their country of nationality or residence is unable or unwilling to provide them with adequate state protection.

Refugees who come to Canada have left their homes and, in many cases, they have had to live in refugee camps for many years. To make a refugee claim, the applicant:

  • Must be physically present in Canada
  • Can’t be subject to a removal order

If you are outside Canada, you cannot claim or file an application under Refugee program. In that case, you should look for other Immigration programs (Federal Skill Worker, Federal Skill Trade, etc.)

to immigrate to Canada.

There are 2 ways you can make your claim:

  • When you arrive at the border.
  • After you’re already inside Canada.

There are different requirements and application process depending on how you make your claim. If you believe that you fall into the definition of a refugee and have sufficient evidence to prove your claim, you can file an application for Refugee status within Canada. Once you have submitted your application along with supporting documents, IRCC Refugee board under current Refugee laws will carefully examine and screen the grounds for your resettlement in Canada under Refugee protection act. While reviewing the application, one of the key factors that the board considers is to ensure applicant do not have issues pertaining to security, criminality, or health.

When you make your refugee claim, you can also apply to work or study while you wait for IRCC Refugee board decision. However, you need to apply for a work or study permit, each of them has their own set of requirements.
